Section 5 of 5 Per country

Three questions per country

For every country of the conversation: is the company already represented there, can it detect infringements, and can and will it enforce its rights there?

No countries chosen yet. The countries come from the questions on manufacturing, sales and future markets.

Why do we ask this?

Already present: Own branch, sales, dealers or customers. Where you are present, you notice copies more easily.

Detect infringements: Do you see products there at fairs, in shops or at customers? A patent only helps where you notice an infringement.

Enforce rights: Enforcing means: warning letter, if needed a lawsuit, with a local lawyer and a budget.

A country’s points are the average of Manufacturing and Customers, weighted as set in the Countries step. Of that, the share given by the Enforcement answer counts: all of it for “Yes”, none for “No”.

Manufacturing = mean of production, relocation and detecting infringements.

Customers = mean of sales opportunity, already present and future market.

Enforcement = the enforcement answer; “not answered” counts as “No”.

Yes = 100, Rather yes = 75, Rather no = 25, No = 0 points. "Not answered" counts 0, as in PatScenario v1.33.

Conversation note for the adviser

Already present:Sales partners and distributors count. So do fairs where the company exhibits regularly.

Detect infringements:Be specific: who would notice a copy, sales, a dealer, a customer? For process inventions this is often hard.

Enforce rights:This answer is a factor on all others: "No" and "not answered" set a country to 0 points.
